Residence Permits

Foreign nationals who wish to stay in Turkey beyond their visa’s specified limit, those exempt from visas, or those intending to stay for more than 90 days are required to secure a residence permit.

1. Short-Term Residence Permit for Foreigners Foreigners looking to obtain a short-term residence permit, especially those owning property in Turkey or those looking to start or connect with businesses, must apply through the e-residence system (e-ikamet.goc.gov.tr) and submit their documents to the local Provincial Directorate of Migration Management. Typically, these permits are valid for up to two years but can extend to five years for investors meeting certain criteria set by the Council of Ministers, who, along with their families, may also pursue Turkish citizenship or a long-term residence permit.

  • Completed application form for residence permit
  • Passport or similar travel document copy
  • Four biometric photos
  • Evidence of adequate finances for the stay
  • Receipts for residence and card fee payments
  • Property deed (if owning property in Turkey)
  • Comprehensive health insurance

Additional documents for business-related applications include:

  • Invitation letter from Turkish contacts
  • Notarized documents such as company activity certificate, tax registration, trade registry gazette, and signature circular


Investors must fulfill one of the following:

  • Invest at least USD 500,000 in fixed capital
  • Buy property worth at least USD 400,000 with a no-resale restriction for three years
  • Employ a minimum of 50 people
  • Deposit at least USD 500,000 in Turkish banks with a three-year no-withdrawal condition
  • Purchase at least USD 500,000 in government bonds with a three-year hold
  • Invest at least USD 500,000 in real estate or venture capital funds with a three-year no-sale condition
  • Contribute at least USD 500,000 to private pension funds, to be held for at least three years

Application for Extension Applications for permit renewals should be submitted at least 60 days before expiry through the e-residence system, with documents mailed to the Provincial Directorate of Migration Management within five business days.

  • Previous residence permit
  • Proof of financial means for the stay
  • Property deed (if applicable)
  • Invitation letter from business contacts (if applicable)
  • Valid health insurance


2. Long-Term Residence Permit for Foreigners Foreigners who have lived continuously in Turkey for at least eight years are eligible for a long-term residence permit, which does not require renewal.

  • Residence permit application form
  • Passport and a copy of it
  • Copy of any previous residence permits
  • Four biometric photographs
  • Confirmation of no social aid received from the government in the past three years
  • Evidence of adequate financial resources for the stay
  • Police clearance document
  • Valid health insurance

 

Work Permits

A work permit is a mandatory document for all foreigners who wish to work in the Republic of Türkiye. This permit is issued by the Ministry of Labor and Social Security, allowing the holder to work and live in Türkiye legally. Working without a permit is illegal and subject to penalties.

There are three types of work permits: Temporary, Permanent, and Independent.

Temporary Work Permit Initially, a temporary work permit is granted for up to one year, allowing the foreigner to work at a specified workplace or position. This duration aligns with the terms of the employment or service contract.

Permanent Work Permit Foreigners who have either a long-term residence permit or have held a legal work permit for at least eight years can apply for a permanent work permit. This permit does not automatically grant legal rights upon application. Holders of permanent work permits have similar rights to Turkish citizens, excluding some specific legal provisions.

Independent Work Permit This permit is issued to professionals for a limited time, contingent on meeting certain legal conditions. Factors such as education, professional experience, contributions to science and technology, and economic impact are considered

Application Process Applications can be submitted within Türkiye or from abroad, through the E-Permit System (https://ecalismaizni.csgb.gov.tr/eizin). Necessary documents include the foreign national’s passport, a photo, and the employment contract.

Domestic Application Foreigners in Türkiye need a residence permit of at least six months to apply. Employers must submit the application, which includes:

  • Employment contract
  • Passport copy (translated if not in Latin alphabet)
  • Copy of diploma or equivalent (not mandatory for home services)
  • Turkish Trade Registry Gazette
  • Recent financial statements

Abroad Application Applications are made at Türkiye’s embassies or consulates in the applicant’s country of citizenship or legal residence. Applicants must start their employment within one month of entry into Türkiye, or their permit may be revoked.

Extension Application Work permit extensions must be applied for 60 days before the existing permit expires. The first extension grants up to two years, and subsequent ones up to three years, under the same employer.

Turquoise Card The Turquoise Card offers indefinite work rights in Türkiye and residency rights for the holder’s family. It involves a three-year transitional period, after which it can be made indefinite.

Overview of Turkey’s Personal Data Protection Law (KVKK)

Introduction Turkey’s Personal Data Protection Law No. 6698, also known as Kişisel Verileri Koruma Kanunu (KVKK), was enacted on April 7, 2016. This law was Turkey’s first comprehensive regulation dedicated to the protection of personal data, setting obligations for those handling personal data.

Establishment of the Turkish Data Protection Authority (TDPA) The TDPA was established in early 2017 as an independent authority tasked with enforcing the KVKK, promoting data protection awareness, and overseeing compliance among data controllers and processors.

Scope and Application The KVKK applies to data controllers and processors that collect or process personal data from individuals in Turkey, including both domestic and foreign entities. The law defines “personal data” broadly and includes special provisions for sensitive personal data.


Key Requirements and Provisions

  • · Registration with VERBIS: Data controllers are required to register with VERBIS (Data Controllers Registry Information System) before starting any data processing activities. This involves appointing a representative in Turkey and creating a Data Processing Inventory.
  • · Deadlines and Exemptions: Registration deadlines have been extended multiple times, with certain exemptions for smaller entities or those processing data non-electronically.
  • Cross-border Data Transfers The law permits international data transfers with explicit consent from the data subject or if adequate protective measures are in place, similar to GDPR standards.
  • Compliance Obligations and Penalties.
  • Data Breach Notifications: Controllers must notify the TDPA of any breaches within 72 hours and have a Data Breach Response Plan.
  • · Penalties: Non-compliance can lead to substantial administrative fines and, in some cases, criminal penalties under the Turkish Penal Code.
